Terms of Sale

Applies to paid subscriptions. Takes effect once payments open.

1. Purpose and scope

These terms of sale ("Terms of Sale") govern the sale of paid subscriptions to the Kestrelia service, concluded remotely between the publisher (the "Seller") and any user acting as a consumer (the "Customer"). Any paid subscription implies unreserved acceptance of these Terms of Sale.

2. Seller

The service is sold by the publisher identified in the legal notice: Sergio Nokam, an unincorporated sole proprietorship under the NOKARIS Lab brand, 101 Saint-Jean-Bosco Street, Suite A-1330, Gatineau (Quebec) J8Y 3G5, Canada — hello@kestrelia.com.

3. Plans and prices

The Premium subscription is offered quarterly (billed every 3 months) or yearly (billed every 12 months, reduced monthly equivalent). Prices, in Canadian dollars (CAD), are those shown on the Pricing page at the time of order; applicable taxes (GST/QST) are added where required. The applicable price is the one in effect at the time of subscription or renewal.

4. Founding Member offer

The first 200 paying Customers may benefit from a Founding Member discount of 50% on the first year, subject to availability. The discount is applied automatically at payment when the Customer is eligible, cannot be combined with other offers and applies only to the first billed period.

5. Order and payment

Payment is made online via our provider Stripe; no card data is processed or stored by the Seller. The order is confirmed once payment is validated by Stripe, which immediately activates the subscription. A receipt is sent by email.

6. Term and automatic renewal

The subscription is entered into for the chosen period (3 or 12 months) and automatically renews at expiry for an identical period, at the price in effect, unless cancelled before the renewal date.

7. Cancellation

The Customer may cancel at any time from their dashboard or the Stripe portal. Cancellation takes effect at the end of the paid period: Premium access remains active until that date, with no further charge, then the account reverts to the free tier.

8. Refunds

Periods already started are not refunded on a prorated basis, except where required by law, in particular under Quebec's Consumer Protection Act for distance contracts (for example in case of a Seller default or non-conformity). Requests: hello@kestrelia.com.

9. Governing law and remedies

These Terms of Sale are governed by the applicable laws of Quebec and Canada, including the Consumer Protection Act. Any dispute falls under the exclusive jurisdiction of the courts of the judicial district of Gatineau (Quebec).
